Who this notice covers

This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Liquivida Wellness Center, 18999 Biscayne Blvd, Ste 105, Aventura, FL 33180. It applies to every member of our clinical and administrative staff, to anyone we allow to access your record while they are working with us, and to our online store.

We are required by law to keep your protected health information private, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice that is currently in effect.

How we may use and share your information

We may use or share your information without asking you first in these situations.

Treatment

To provide, coordinate or manage your care, such as sending your lab results to the physician who prescribed for you, or telling a pharmacy what to compound.

Payment

To bill and be paid for your care, including checking eligibility and processing your order.

Health care operations

To run the clinic: quality review, staff training, audits and business planning.

Business associates

To companies that work for us: our laboratory, pharmacy partners, scheduling software and payment processor. Each is bound by a written agreement requiring the same protection we give your information.

Appointment reminders and follow-up

To contact you about an appointment, a refill or a result. Tell us in writing if you want these sent a particular way and we will accommodate reasonable requests.

Treatment alternatives

To tell you about a treatment option that may interest you. Marketing paid for by a third party needs your written authorisation first.

As required by law

Public health and communicable disease reporting, suspected abuse or neglect, health oversight, court orders and subpoenas, qualifying law enforcement requests, coroners and funeral directors, organ procurement, workers' compensation, and to avert a serious and imminent threat to health or safety.

Uses that always need your permission

• Most uses and disclosures of psychotherapy notes.
• Use or disclosure of your information for marketing.
• Any sale of your information.
• Most sharing of substance use disorder treatment information.

Any other use or disclosure of your information, not described anywhere in this notice, will be made only with your written permission.

If you give permission you can take it back in writing at any time. That stops future sharing, but it cannot undo a disclosure already made while the permission was in force.

Your rights

Get a copy of your record

You may inspect and receive a copy of your medical and billing records, on paper or electronically. We will respond within 30 days and may charge a reasonable, cost-based fee.

Ask us to correct it

If something in your record is wrong or incomplete you may ask us in writing to amend it. If we decline we will tell you why in writing, and you may file a statement of disagreement that we will keep with the record.

Get a list of disclosures

You may ask for an accounting of disclosures made in the six years before your request, other than those for treatment, payment and operations. One list in any twelve months is free.

Ask us to limit what we share

You may ask us to restrict a use or disclosure. We are not required to agree, with one exception: if you pay for a service in full and out of pocket, you may tell us not to share information about it with your health plan, and we must comply.

Choose how we contact you

You may ask us to reach you at a particular number or address, or by a particular method. We will accommodate reasonable requests and will not ask you why.

Be told if your information is breached

We will notify you promptly if a breach compromises the privacy or security of your information.

Get a paper copy of this notice

You may ask for one at any time, even if you agreed to receive it electronically.

Choose someone to act for you

Someone with medical power of attorney, or a legal guardian, may exercise these rights for you once we have verified their authority.

Complaints

If you believe your privacy rights have been violated, tell our Privacy Officer, or file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington DC 20201, on 1-877-696-6775, or at hhs.gov/ocr/privacy/hipaa/complaints.

We will not retaliate against you for complaining, and it will not affect your care.

Changes, and Florida law

We may change this notice and apply the change to information we already hold as well as to information we receive later. The current version is always on this page and displayed in the clinic, with its effective date.

Where Florida law protects you more strongly than HIPAA, around HIV testing, mental health records, or the treatment of minors, the stronger protection applies.
